This Client Services Agreement ("Agreement") is entered into between BuildMyWebNow, owned and operated by Symon Bowen ("Designer"), and the client identified on the signature page ("Client"), as of the date of the last signature below.
Designer will provide the services described in the selected package or written proposal (the "Project"), which may include website design, development, and related services as agreed. Any work outside the agreed scope ("out-of-scope work") will be quoted separately and requires Client's written approval before it begins.
Designer will make reasonable efforts to meet the estimated timeline. Timelines depend on Client providing content, feedback, and approvals promptly. Delays in Client materials will extend deadlines accordingly.
The Project includes the number of revision rounds stated in the selected package. Additional revisions beyond that are available at Designer's then-current hourly rate, always quoted in writing and approved by Client before the work begins.
Upon receipt of full and final payment, Client owns the final website, its custom content, and its domain. Until full payment is received, all work remains the property of Designer. Designer may use non-confidential elements of the finished Project in its portfolio and may include a discreet "Website by BuildMyWebNow" credit unless the parties agree otherwise in writing. Third-party components (fonts, libraries, stock assets) remain under their own licenses.
Designer builds using current best practices but does not guarantee any specific search-engine ranking, traffic, lead volume, or revenue. Search engines independently control rankings, and results take time.
If Client cancels the Project after work has begun, the deposit is non-refundable, and Client agrees to pay for all work completed up to the cancellation date. If Designer cancels, Designer will refund any pre-paid amounts for work not yet performed.
Designer's total liability under this Agreement is limited to the total fees paid by Client for the Project. Designer is not liable for indirect or consequential damages, or for issues caused by third-party providers, hosting outages, or Client-supplied materials.
Designer will correct defects in the delivered work reported within the post-launch support period stated in the selected package. This warranty does not cover changes made by Client or third parties, new feature requests, or third-party service failures.
Each party agrees to keep the other's non-public business information confidential.
This Agreement is governed by California law. The parties will attempt to resolve disputes in good faith; unresolved disputes will be handled in the courts of San Bernardino County, California.
This Agreement, together with the selected package or proposal, is the entire agreement between the parties and supersedes prior discussions. Changes must be in writing and agreed by both parties.
